Terms of Service

Please read these Terms of Service carefully before purchasing or using any products or services offered by Total Solutions Agent™, owned and operated by The Sierra Group, LLC ("Company," "we," "us," or "our") at www.totalsolutionsagent.com (the "Site"). By accessing the Site or completing a purchase, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Acceptance of Terms
By accessing or using the Site, placing an order, or enrolling in any program offered by Total Solutions Agent™, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be legally bound by them. These Terms apply to all visitors, users, and customers of the Site.
2. Products & Services
Total Solutions Agent™ offers digital educational products and programs designed for real estate professionals, including but not limited to:
• The Total Solutions Agent™ Program (one-time digital purchase)
• Bonus materials, including supplemental guides and video content
• Optional one-on-one implementation coaching calls
All products and services are delivered digitally. Upon successful payment, you will receive access instructions via the email address provided at checkout. We reserve the right to modify, suspend, or discontinue any product or service at any time without notice.
3. Pricing & Payment
All prices are listed in U.S. dollars and are subject to change without notice. By submitting a purchase, you authorize us (or our payment processor) to charge the stated amount to your provided payment method. You represent that you are authorized to use the payment method submitted.
We use a third-party payment processor to handle all transactions. We do not store your full credit card information on our servers. You are responsible for any applicable taxes associated with your purchase.
4. Refund Policy
Important: Due to the immediate digital nature of our products, all sales are generally considered final. Because you receive instant access to the full program upon purchase, we are unable to offer refunds once access has been granted.
If you experience a technical issue that prevents you from accessing the program, please contact us at Support@SGRealEstate.com within 7 days of purchase and we will work to resolve the issue. Refund requests based on dissatisfaction with program content or results are not guaranteed and will be evaluated on a case-by-case basis at our sole discretion.
Coaching call fees are non-refundable once the call has been scheduled or completed.
5. Intellectual Property
All content included in or made available through the Site and the Total Solutions Agent™ Program -- including but not limited to text, graphics, logos, video content, audio clips, scripts, templates, and course materials -- is the exclusive property of The Sierra Group, LLC and is protected by applicable copyright, trademark, and intellectual property laws.
Upon purchase, you are granted a limited, non-exclusive, non-transferable, personal license to access and use the program materials for your own professional development. You may not:
• Copy, reproduce, distribute, or resell any program content.
• Share your login credentials or grant access to any third party.
• Use any content to create competing products or services.
• Remove or alter any copyright, trademark, or proprietary notices.
6. Earnings & Results Disclaimer
The income figures and results mentioned on this Site (e.g., $75,000-$100,000+ in annual recurring income) are illustrative examples based on real-world experience and are NOT guarantees of individual results.
Your results will vary and depend on many factors, including but not limited to your individual effort, experience, local market conditions, and the time you invest in implementing the program strategies. Total Solutions Agent™ makes no guarantee that you will achieve any specific financial outcome. All business activities involve risk, and past results do not guarantee future performance.
7. Disclaimer of Warranties
The Site and all products and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Ben Souchek and The Sierra Group, LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages -- including lost profits, lost revenue, or loss of data -- arising out of or in connection with your use of the Site or purchase of any product or service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid to us in the 30 days preceding the claim.
9. User Conduct
By using the Site, you agree not to:
• Use the Site for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to any portion of the Site or its related systems.
• Transmit any unsolicited or unauthorized advertising or promotional material.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Interfere with or disrupt the integrity or performance of the Site.
10. Third-Party Links
The Site may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party sites you visit.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Lincoln, Nebraska, in accordance with the rules of the American Arbitration Association.
12. Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we do, we will revise the "Effective Date" at the top of this page. Your continued use of the Site following the posting of any changes constitutes your acceptance of those changes. We encourage you to review these Terms periodically.
